The Tobacco Products and Electronic Delivery Systems Control Bill
The long-awaited Bill (in its current draft) treats vape products similarly to tobacco: no display outside age-restricted areas, plain packaging requirements, no flavour descriptors that appeal to minors, an advertising ban, and no vaping in public indoor spaces or within a specified distance of school and hospital entrances.
What is already in force
The excise duty on nicotine-containing e-liquid, the SARS registration requirement for importers and manufacturers, and standard consumer protection laws under the CPA and POPIA apply already.
The advertising ban
Once the Bill is enacted, direct advertising of vape products — including online display advertising, social-media influencer promotion, and traditional media — is prohibited. Age verification at delivery
The Bill formalises what many retailers already do: couriers verify age on delivery for age-restricted goods. Expect this to become standard across all reputable vape retailers.
